The attorney for the mother in the so-called 'Boy in the Box' case appeared in court Friday morning.
Jennifer Marshall requested to be removed from the case of Tracy Ferriter, whose husband was convicted of abusing the couple's adopted son by forcing him to stay in a box-like structure in the garage of their Jupiter home.
Marshall is citing an "irreconcilable difference" between herself and Ferriter. The judge granted the request but is keeping the trial set for January and said any new attorney that takes on the case will have to be ready to go.
The hearing at the Palm Beach County Courthouse was originally scheduled to focus on the defendant's financial means, but a motion to declare her indigent for court costs was withdrawn.
Ferriter faces the same charges that her husband was convicted of. A jury in October found Tim Ferriter guilty of aggravated child abuse, child neglect and false imprisonment.
He was sentenced to five years in prison.
